Crash victims warned against quick settlements

 

Recent media reports that crash victims are being pressurised into accepting quick payouts from insurers highlight a worrying trend, but one that can be avoided say Barr Ellison's personal injury experts.

“Some insurers have been accused of contacting victims within hours of an accident pressurising them into a settlement,” says Barr Ellison Partner and personal injury specialist Sarah Hefferon. “These people are probably in pain, worrying about missing work, fixing their car and other financial concerns, so it’s not surprising they agree to settle. They need legal advice before accepting anything and what many people don't realise is that an initial interview with a solicitor is usually free.”

This so called ‘third party capture' was brought to light by road accident charity Brake, which said it was very common for the driver who is not at fault to be contacted by the other person's insurers to push them to settle quickly. These companies often convince the victims that they will incur huge costs if they seek legal advice but this is unlikely to be the case adds Sarah Hefferon: “Most claims settle out of court and it's also usual for a victim to receive an interim payment to alleviate any financial worries.”

Even if drivers have legal expenses cover as part of their insurance it is still worth contacting a solicitor experienced in this area.”With legal expenses cover the case will be passed on to a panel solicitor who could be anywhere in the country so you are unlikely to meet them. It's much better to meet your local solicitor face to face, allowing them to assess your needs and offer the right advice and support during what is a very difficult time.”
