Enfranchisement / Right to Buy Legal Advice

A growing number of leaseholders are investigating the possibility of buying the freehold of their house or flat, and Barr Ellison has become one of the leading firms in Cambridge acting for leaseholders in this field.

The advantages to leaseholders are clear – it allows them to manage their own building and grant themselves long leases. However, the process can be complicated, particularly where flats are concerned. Read more in article From Leaseholder to Freeholder.

Leasehold houses

  • Purchase of freeholds under the Leasehold Reform Act 1967
  • Extension of leases under the Leasehold Reform Act 1967

Leasehold flats

  • Purchase of the freehold of a block of flats under the Landlord and Tenant Act 1987 (where the landlord offers the freehold to the leaseholders)
  • Purchase of the freehold of a block of flats under the Leasehold Reform, Housing and Urban Development Act 1993 (where the leaseholders initiate the process)
  • Extension of leases of individual flats under the 1993 Act
  • Advice on ‘right to manage companies’ under the Commonhold and Leasehold Reform Act 2002

 

NB If you receive any notice from your landlord under the 1987 Act, you should make contact with us as soon as possible, as there are strict time limits imposed.
